Every business, charity and public sector organisation in England must separate dry recyclable materials, food waste and non-recyclable waste before collection. That duty took effect on 31 March 2025. Micro-firms with fewer than 10 full-time equivalent employees across the whole business have until 31 March 2027, and do not need to register for that. Simpler Recycling is usually summarised as three bins. It is actually a set of separate obligations, some on the waste producer and some on the waste collector, with two different commencement dates. This table separates them so you can see which ones are yours.

- England's workplace recycling duty took effect on 31 March 2025 for every business, charity and public sector organisation, with micro-firms of fewer than 10 full-time equivalent employees given until 31 March 2027.
- The micro-firm test counts full-time equivalent employees across the whole business, not per site: gov.uk's own example is that a business with 3 locations and 5 employees at each has 15 employees and is not a micro-firm.
- Workplace food waste must be collected even where the workplace does not serve food or have a kitchen, and no matter how little food waste there is.

When did workplace recycling become law in England?
On 31 March 2025. From that date all businesses, charities and public sector organisations in England must separate dry recyclable materials, food waste and non-recyclable waste before collection. Micro-firms with fewer than 10 full-time equivalent employees have until 31 March 2027.
What must a workplace separate?
Three streams: dry recyclable materials (plastic, metal, glass, paper and card), food waste, and non-recyclable or residual waste. Waste produced by employees, customers and visitors is included, and workplaces generating garden waste must arrange for it to be recycled or composted where that delivers the best environmental outcome.
Who counts as a micro-firm?
A business with fewer than 10 full-time equivalent employees counted across the whole business, not per site. Part-time employees count pro rata by hours; volunteers, contractors and self-employed workers do not count. No registration or application is needed to rely on the later date.
Do these rules apply in Wales, Scotland and Northern Ireland?
No, each nation has its own regime. Wales has required workplaces to separate six streams since 6 April 2024. Scotland has required separate collection of dry recyclables from non-household waste producers since 1 January 2014, with a food waste duty for food businesses. Northern Ireland's statutory requirement centres on food businesses producing 5kg or more of food waste a week.
Does my waste collector have to do anything?
Yes. Collectors must collect dry recyclable materials and food waste separately from non-recyclable waste, must not later mix separated waste with other streams, and must collect paper and card separately from plastic, metal and glass unless they complete a written co-collection assessment. Compliance notices can be issued against collectors as well as producers.
What happens if a workplace does not comply?
gov.uk states you are at risk of a compliance notice from the Environment Agency, and that failing to comply with a compliance notice is an offence, with enforcement following the Environment Agency's Enforcement and Sanctions policy. Anyone can report a non-compliant workplace or collector to the Environment Agency.
